These Terms govern your use of THE FACTORY (the Service): the getthefactory.com website, the terrain preview and download tools, and the THE FACTORY desktop application. By using the Service you agree to these Terms.
THE FACTORY generates three-dimensional terrain from publicly available global elevation data for use in compatible third-party games that you separately own. Free previews are available without an account; downloads require a membership.
You are responsible for activity under your account and for keeping your sign-in secure. Provide accurate information and be old enough to form a binding contract in your jurisdiction.
Paid downloads require an active membership of 19.99 US dollars per month, billed through our payment processor, Stripe. Membership renews automatically until you cancel. Cancel at any time from Manage membership on the site and keep access until the end of the current billing period. Except where required by law, payments are non-refundable for partial periods. Pricing may change with reasonable notice.
We grant you a personal, non-exclusive, non-transferable license to use the application and the terrain files it generates for your own gameplay. Do not redistribute, resell, or reverse engineer the application or operate it as a service for others.
All software, artwork, logos (including the “[+]” mark), copy, and original assets in the Service are copyright © PLACES I NEVER HEARD OF LLC. All rights reserved. THE FACTORY is an independent studio and is not affiliated with, endorsed by, or sponsored by Atari, Frontier Developments, or the RollerCoaster Tycoon franchise. Those names are trademarks of their respective owners and are referenced only to describe compatibility. Generated files are intended for use with software you lawfully own.
Do not use the Service unlawfully, attempt to bypass membership or staging controls, probe or disrupt our infrastructure, scrape at volumes that degrade the Service, or use it to infringe the rights of others.

The Service is provided as is, without warranties of any kind. Elevation data reflects its sources and may contain errors. To the fullest extent permitted by law, PLACES I NEVER HEARD OF LLC is not liable for indirect or consequential damages, and our total liability is limited to the amounts you paid in the prior twelve months.
You may stop using the Service at any time. We may suspend or terminate accounts that violate these Terms; if we terminate without cause, we will refund the unused remainder of the current billing period.
We may update these Terms; material changes will be posted here with a new effective date. Continued use means acceptance.
These Terms are governed by the laws of the State of West Virginia, USA, without regard to conflict-of-laws rules.
